The independent European media outlet Voxeurop published on August 14 the analysis “The cost of a captured judiciary in North Macedonia” by Xhabir Deralla, examining how political influence over the judiciary, selective justice and SLAPP-style pressure on independent voices are damaging democracy, the economy and the country’s European prospects.

The article argues that the consequences of a captured judiciary extend far beyond individual court cases. When courts and prosecutors become vulnerable to political command, Deralla writes, the rule of law is transformed from a democratic safeguard into an instrument of political discipline.

Particular attention is given to court proceedings against independent media, civil society organisations and critical intellectuals, including cases displaying characteristics of SLAPPs – strategic lawsuits against public participation. Such pressure, the article warns, creates a chilling effect and encourages self-censorship among those whose role is to scrutinise power.

The analysis also examines the economic consequences of politicised justice. Legal unpredictability, selective enforcement and politically influenced corporate cases undermine confidence among serious foreign investors, who depend on legal certainty, enforceable contracts and impartial dispute resolution.

A central part of the article deals with North Macedonia’s EU integration. Deralla argues that European integration cannot be reduced to political declarations, legislative procedures or negotiations with Brussels while the institutions expected to uphold European democratic standards are being weakened at home.

“A country cannot claim to defend its identity on the road to Europe while dismantling the very European values that make that road meaningful.”

The article is also critical of the European Union’s approach, warning that an emphasis on short-term stability and formal compliance can help preserve the appearance of reform while democratic institutions are being hollowed out.

“The widening gap between pro-European rhetoric from political podiums and autocratic tactics inside courtrooms is actively sabotaging North Macedonia’s European future,” Deralla writes.

The analysis concludes that the price of political control over justice is ultimately paid by the entire country – through weakened democratic institutions, economic stagnation and an increasingly uncertain European future.
