At tonight’s regular session, the Government of the Republic of Northern Macedonia adopted the opinion of the Ministry of Health that non-combustible tobacco products and their heating devices do not fall under the ban on smoking under Article 3 paragraph 1 of the Law on Protection from Smoking.
According to the Ministry of Health, the use of non-combustible tobacco products, their heating devices and electronic cigarettes does not constitute smoking and consequently, do not fall under the ban on smoking from Article 3 paragraph 1 of the Law on Protection from Smoking, ie they can be used and in the closed part of the public premises, having in mind the provisions of Article 3 paragraph 1 item 3 of the Law on Tobacco, tobacco products and related products.
This is because according to this provision smoking is defined as “possession or use of a tobacco product that burns, whether the smoke is actively inhaled or exhaled.”
